Great example! That should settle it. Next time, MacDonalds will hand you the empty cup, or offer you the option of paying a "handling fee" of 50 cents and they will fill the cup for you. After all, it does take time and manpower to fill the cup, why should they pay for it? That's what the handling fee is for. If you don't like it, then just don't buy a drink there. Sheesh. Governments cannot, and do not grant anything like a grant of patent for someone to sell and buy. People have an inalienable right to sell and buy. They may be required to have a pushcart license to be on the street selling, but that varies. There have been successful defenses of farmer's markets/fuit stands on right of ways before. You can resell CDs, but CDs are not DVDs. You can't resell software, for example. Violates the EULA.
