Default New and sealed? How about NOT?

Advertised as "New and Sealed" and "free postage", which is the reason I
(and others) went higher for it. Ordinarily, this goes on eBay for £9 - £10
secondhand, and £10 - £11 if sealed - I checked closed items before. Turned
up OK, in good condition, but DVD box has faint scratches on sleeve
plastic - sure sign of secondhandedness, is this bait and switch? It is also
possible that the DVD has been copied - with the seller keeping the copy -
one reason why I don't usually buy DVD's from eBay, although this is
unlikely, as the seller had three for sale. My main reason for posting here
though is because I paid over the odds for the item, plus he said in his EOA
e-mail that if I wanted recorded, it would be £1 extra, fair enough, as I
didn't want it "going missing in the post"

So, before I do anything, I thought I would ask the group's opinion.

Do I :-

Ask him to part-refund a couple of quid as the difference, or just leave
positive/neutral to the tone of "Good overall, but you should not advertise
it as "sealed" if it is not."?

Ask him for a partial refund at least, explaining what you've said here and
then play it by ear according to response.

I like the bit that said:
REGISTERED DELIVERY FOR SAFE FAST POSTAGE!!!

Not quite up to date with his facts there - so is there anything else he's
not 100% on?

I would start by emailing him and politely bringing to his attention thatyou bid
on a sealed DVD and received a non sealed one. Maybe he sent you the wrong one.
I'd base my actions on his response.

Give him a chance first so you can find out if it was a genuine mistake or
not, then take it from there. Might not be fair to neg him straight away.

He says he'll return my cheque or send another sealed DVD if I return it to
him first, but won't part refund £3 difference between sealed/unsealed as
DVD is working. I've been in contact with the other buyers in the auction
and theirs were unsealed too. If I do return, I suppose he thinks he can
flog it as sealed again and people won't bother to complain as it will be
too much hassle. £3 will be what it's going to cost him for me to ship it
back and him to ship a new one recorded each way, I told him this, still no
go.
